Legal Question in Family Law in California
Getting the financial support that my child deserves.
My daughter's father has chosen not to work since I have filed for suport. He lives in another state and he's living off of the sale of his home and business from CA. He is claiming not to have any money. His income from last year was approx. 85,000. Can I request the DA to ask for a back to work order form? Anad can he be held to the level of income that he;s use to having?

Re: Getting the financial support that my child deserves.
The court can use the cash that he has to set child support. An order that he make an effort to obtain employment is routinely made in Calfiornia. Stopping work to avoid child support can justify the court using his ability to earn. Most attorneys working for the department of child support services are quite vigorous in pursuing these cases.
