How do I find out?

I need to know how old a child must be before he or she can decide who they want of live with.

My 8 year old lives in California with her dad. She doesn't want to be there and its breaking my heart.

A minor child is never allowed to decide who to live with. However, after age 13 a judge must at least listen to the minor's desires and take them into account. This does not mean the minor gets to decide, however. Before age 13 the judge does nor even have to listen to what the minor wants.
