Legal Question in Family Law in California
Where do I find out about Child Support laws?
My situation is that I would like to marry a man who has two children from a previous relationships. If we get married is the state of California going to try to take 25% of my wages and or earnings to pay for his children? He is responsible and has never missed a payment! If we have a child together will it change anything about his present child support payments? Does the State of Califonia only take 25% or can they take more then that? Does he have to pay child suppot to the mothers when the children are past the age of 18 and they are still living at home? Where can I find these answers without hiring a lawyer? Isn't it my legal right to now the laws before I marry some one? Where can I find these answers?

Re: Where do I find out about Child Support laws?
California is a community property state. One half of his income is yours and one half of your income is his. How ever the family code provides that child support is first deducted from his separate property and then community property. So long as he has a job and income the child support payments must be taken from his income.
If you are employed your income is considered only to the extent that is affects the amount of income taxes the he pay.
If the two of you have a child he may be allowed a hard ship deduction which would decrease his child support.
He must child child support until a child reaches age 18 or if the child has not graduated from high school and is enrolled full time high school student until the child either reaches age 19 or grasuates from high school.
