You should consult with the Family Law Facilitator in your county as well as an experienced family law attorney. When you file for divorce you will need to file for sole legal and physical custody of your child. While your child's father may have significant mental health issues and a history of domestic violence, these challenges do not categorically deny him his rights as a father to have contact with the child. You need to develop a strategy for parenting issues that may involve limiting visitation to supervised settings and taking other steps to assure your child's safety. Good luck with this.
