You may own a community property interest in the house. If income which was earned during the marriage was used to pay the mortgage or make improvements to the house, you would be entitled to 1/2 of the community interest. You should consult with a family law attorney so that you can have a better understanding of what your interests in the property are.
Using joint community credit (refinancing by both spouses) can also impact if there is a community property interest in the home.
Consulting with an attorney who will review all the facts of your case is the best way to find out what your rights are regarding a divorce.
