Legal Question in Family Law in California

Finding possible child from past relationship

My husband and I are currently trying to determine if he has a child from a relationship that ended in early 2004. When he and his ex split up she was pregnant. A few months later he moved to Oregon, met and married me, and has had a hard time finding out facts about what happened with the pregnancy and/or possible birth. She's told some people that she had an abortion, and told others that she has a son. He and I have confronted her directly about the issue and she tells us it's none of our business. How would we go about first determining if there is a child from the relationship, and then establishing paternity if there is a need?

Re: Finding possible child from past relationship

Check the birth records in the county in which she lives. Anyone who has experience in tracing their family tree should be able to assist you. If that does not satisfy you and your husband hire a private investigator to check it out. If she has a child then he can file a petition to establish paternity. Pursuing this course of action will subject him to a substantial financial obligation. California support is determined by computer program. The per cent of time the child is with each parent has a tremendous affect on the amount of child support. Visitation from Oregon will also result in a considerable consumption of time and money.
