Legal Question in Family Law in California

Can I be forced to go back to work?

I do not have custody of my 7 & 13 year old sons. The state requested the father to take me to court for child support because he has them on welfare. He is able to work but does not and lives with his parents. My current boyfriend and I have infant twin daughters. They are prone to illnesses and so I stay home with them and would like to continue to do so until they start school. My boyfriend has put my 2 sons on his insurance so they do not need help from the state. Also, we are more than willing to take them into our custody full time. But because of past issues, which included domestic abuse the court will not allow it. The children were not endangered or abused. My finace has gone to parenting and anger management classes for the last 2 years and we have both completed any and all requests from the court. This situation happened 3 years ago. We are now a stable family are planning to marry and have room for the boys. The judge told me the other day that by September 20, 2004 I HAVE to go back to work. The girls will be 1 by then. I do not want my girls in day care. Can I be forced to go back to work? The judge made it sound like I do not have a choice. The social worker also said I must go back to work. What is going on?

Family court cannot force you to go back to work. If there is a criminal action a condition of your probation maybe that you have to obtain employment.

The family court may set support based upon your ability to earn, if there is a finding that it is in the children's best interest.
