Legal Question in Family Law in California

foreign marriage-california divorce

My daughter is an American citizen who married another American citizen in Guatemala where both are presently residing. The marriage was not recognized at the American Embassy.They now have 3 small children. She wants to come to California with the children and apply for a divorce and then come to Spain to live with us where we can help support her and the children. My question is: would she be able to leave the USA with the children after filing for divorce since she has no financial means with which to support herself and the children?

Unless there is a court order forbidding it she can go anywhere she wants with the kids. Why don�t you see what it would take for her to move to Spain and then get a divorce there?
