Legal Question in Family Law in California

forgiving back child support

How should I go about informing the DA's office that I want to ''forgive'' unpaid child support. Is interest included? Any special wording I should use. (X is in poor health)

Re: forgiving back child support

You can try contacting the Child Support division of the DA's office give them your case number and explain to them the situation. However, I believe according the California law, once a claim for past child support is filed the debt cannot be forgiven or the case closed until the debt has been paid in full. I would contact the DA's office immediately because they may start taking criminal action against your ex for not paying even though you have forgiven the debt.

Good luck.
