Legal Question in Family Law in California
What form do I file with for property settlement?
Last year I filed for & was granted divorce (no children involved). As part of divorce judge ordered that our home (paid in full) would be put up for sale if neither of us could buy the other out. House was put on market but prior to sale my ex-husband & I reconciled. Unfortunately this is not going to work out but my ex now refuses to buy me out or sale the house. I have absolutely no money for attorney & must bring suit for sale of home on my own. Have researched I know about pleading form etc. I'm pretty sure I need to begin w/ ''Order To Show Cause'' but would appreciate confirmation.
Thank you

You have funds coming from the sale of the home and I would think that you could find an attorney who would wait until the home is sold to be paid. I do not know what county you are in but in San Diego County the local court rule states that attorney's fees will be paid out of liquid community assets, which would be the sale of the home.
