Legal Question in Family Law in California

what forms to use when dropping a case

I need to know what forms to use when droping a family law case. I have been going through a custody and child support process and have resolved the matter and wish to drop it. can I drop it using a form instead of going to court? I do not want to take time off of work or drive the two hours to get there if I can file somthing to drop the matter.

To dismiss the case you would use a Dismissal of Action form. Be careful though, as dismissing the case eliminates any orders previosuly made, if any. I suggest that you consult with a family law lawyer before dismissing the case.

Good luck to you!

If you do not show up in court the motion will go off calendar, which is what you want. Let the other party know, in writing, that you will not be showing up. If you have a written agreement you can submit that to the court and make it a court order, however, it will need to be in a proper format. I wouldn't suggest dismissing the case.
