Legal Question in Family Law in California

Necessary Forms to Request Retirement Benefits

After a 23yr. marriage, my divorce was final in 1999. I was awarded $200 a month of spousal support, which my ex has never paid on time, being at this timew in arrears since 9/04.

He just retired from Civil Serevice and I need to file papers with the court to request division of his retirement

benefits, which the court reserved jurisdictiojn over.

Can't afford a lawyer, (did my own divorce paperwork and fees were waived), so I need to know the specific forms I need to file to request division of retirement benefits.

Please help! Thank you very much.

Re: Necessary Forms to Request Retirement Benefits

You need to have a Qualified Domestic Relations Order prepared. There is not judicial council form as there was for your dissolution. Most Family Law Attorneys do not prepare them because they are complicated, so your chance of getting it right by yourself would be slim. You may have to bring a motion to have the order accepted by the court. You are losing money by any delay, so I would suggest you start moving quickly. Good Luck, Pat McCrary
