Legal Question in Family Law in California

A friend is filing for divorce. She owned a house and ran a successful business from that house. However, she had to flee from that house and close down the business due to physical threats from her husband (police reports filed)and damage to her business. Husband remained in house and would not leave. He is not employed and cannot keep up payments on the house. In the meantime, he underwent surgery and is now temporarily disabled. Will a judge in California remove a temporarily disabled man from the house? The friend wants to move back into her house and remove him.

The results of your friends request has everything to do with timing. Your fact pattern suggests some significant amount of time passed from when wife left the house due to husbands abusive conduct and husbands surgery and resulting temporary disability. She should meet with an experienced family law attorney to assess her legal options.
