This answer should not replace the legal advice you should seek in an office consultation with an attorney skilled in CA family law.

With that being said, absent health or saftey issues, the court supports the parents sharing joint legal custody. Joint legal means that the parents participate in the health, welfare and educational decisions in raising the child.

Actual time share or physical custody is a quality not quantity of time issue. If father is currently in the military active duty, then his actual timeshare with the newborn will be affected by this. Best to consult with an attorney to fully explore your legal options!
