Legal Question in Family Law in California
I have a friend who is 17 1/2 years of age. She is going through absolute hell right now with her parents. One lives in L.A. while the other lives about 200 miles from there. She does not under any circumstances want to live at either house. Is there any way she can emancipate herself? She is fully capable of supporting herself but her parents will not let her file for emancipation. Recently, something had happened between the her and the parent she currently lives with and CSS was called. The worker hasn't come yet, but would she be able to help her out? What are her options if she intends to become emancipated?

I don't believe it's possible for a child to become emancipated if they are not able to support themselves. Most likely she would go onto government assistance and that would be paid for by the county. Therefore, the child should just wait a few more months before she turns 18 and she will be a certified adult. Any court proceeding she attempts would certainly take longer than the 6 months more she has to wait before she turns 18.
For self represented individuals you can consult with the family law facilitator self help center at your local court house.
As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
