Full Custody and Adoption

My son is 9 years old and has lived with me since he was born. His biological father has had no contact with him in a while and he has paid no child support. I have been married for a little over 2 years now and I want to have my husband adopt my son. What is the best way for me to go about getting this done?

There are a couple of ways to do it: Either give the biological father an opportunity to sign a form indicating that he agrees to give up his rights, or file with the court to have the court terminate his rights.

You need to file a petition for adoption with the court. If the biological father does nothing, the court will probably allow your husband to adopt your child. But if the bio father objects, it is unlikely the adoption will go through.
