Legal Question in Family Law in California

Can I get full custody?

For the past 5 years I have had joint custody with my ex-wife. She

has lived with her mom for those past 5 years. On the nights that

she was supposed to be with our kids, she would instead leave

them with her mom, and go stay with her boyfriend coming back in

the morning. The kids have become to despise her, and told me

that they want to live with me full time. She has never had any

interest in our kids everand told her mom that if I took her to court

for full custody, she would shoot me, then pull the gun on herself.

She finally moved out of her moms house and into a house with

her new husband. I just dropped the kids off at her new house. She

has been their for 3 weeks and there are no beds in their room, no

food that they eat ,no land line hooked up nothing that make it feel

like it was a house where kids stay. I had to bring down clothes for

them, comforters and pillows for their beds(that aren't there) and

gave her a grocery list of food that they eat. The kids looked at me

and asked me if they could come back home. She doesn't know

how to be a parent and I, along with everyone else, including her

mother, feel they are not safe. Help!!

In a general sense, you need a parenting plan (custody\visitation order) that reflects the best interests of the children.
