Legal Question in Family Law in California

I have full custody of my 3 year old child. Her father has not visited once since she was 2 weeks old. He is behind in child support. I have no contact with her father. I want to take my child out of the country for vacation. Am i allowed to take her out of the country for vacations?

You would have to read your divorce orders to find out. Generally, yes, you need the other parent's consent or a court order to take children out of the country. The U.S. government will also require his consent or a court order to issue a passport.

Check your divorce decree to see whether there is any limitation. Worst case you can petition the court for the vacation.

If you have sole legal and physical custody of your child, you do not need the father's consent to get a passport, just give them a copy of your custody order. As for out of country travel, you can do so as long as it is not prohibited by your custody/visitation order. Good Luck.
