Legal Question in Family Law in California

I have full and legal custody of my 2 and a half year old.The father does not pay court mandated child support nor does he visit regularly, he visits on average twice a month for two hours. Sometimes even less. I have the option of moving out of the United States with the paternal grandparents who serve as co-parents. Can I legally make this move?

Without knowing the details of your court ordered custody and visitation order, I would take a conservative approach and propose that you should return to court to modify the orders to allow this move. The court has a duty to ensure that the child has a continuing relationship with both parents. Any plan to move should include your proposal on how you intend to make the child available to see father.
