Legal Question in Family Law in California

my future husband and i would like to draft a prenup. we havent set the date cuz we want the prenuptial agreement first. i would like to know if its better getting a form online or having a lawyer draft it for you? Also i would like to know how much is the less an attorney would draft a prenup and how long does it take to have the final document? thanks Laura

You should seriously consider having an attorney draft your prenup. Not only will you insure that it is done correctly, but you will have protection if it is ever questioned in the future. The cost for most prenups is fairly minimal (i.e. a little more than a will). If Oprah was marrying Bill Gates it would be a quite a bit more. It really comes down to terms and conditions of the agreement and the assets and debts involved. Feel free to give me a call.

I agree with Mr. Kane. The fees depend on how much property the parties have. I've done simple ones for $1,000.00. They are a lot more involved than just filling out a form, as I tend to discuss the ramifications of a prenup with the parties, and have to refer them to independent legal counsel to comply with state law. (If you want it to be valid, but parties have to have the opportunity to consult with independent counsel, and either do so, or waive that right in writing.)
