Legal Question in Family Law in California

Future Husbands past debts

I am planning on marrying the Father of my son.He has two other children by two other women.Though he is now current in his child support payments he does owe each woman back child support that are now in arrears. If I marry him can my wages be garnished to pay this past debt? Also could they place any type of lien on a house I may purchase after we marry? Do you recommend that I purchase the house before I marry him?

Collections can only be made on accounts that have his name on them. They cannot attach your wages for his child support obligations.

If his name is on the house, then a lien can be put on the house for his arrearages. It does not matter when the house is purchased -- it only matters whether or not his name is on the house.

I would suggest you have a meeting with an attorney to make sure all of your questions are answered and that you take steps to protect yourself, your child and your assets from support arrearages.
