Legal Question in Family Law in California
Gaining primary custody
I currently have 50% legal and am the visiting parent to my 7 yr old son. His mother has recently been fired from work (apparently from fraud) and has decided she is going to move with my son to somewhere around Yosemite to be with her boyfriend and to go back to school (this is over 180 miles from where she is now which is in Yuba City). I need to stop this madness for my son's sake and need some help ASAP. His friends are all here, his life has always been here. I have also already paid for his years tuition at his school, but most importantly, I cannot stand the idea of him being over 150 miles from me (I live in Sacramento). His mother has moved him 3 times in the last year alone (all local until this planned move). I would like to gain primary custody - but I am the father in a court in California and his mother is not a felon or a druggie. She even offered to waive child support and transport him each way as a bribe to me accepting this - which means nothing to me if he lives that far away. Please help!

Re: Gaining primary custody
File a motion to stop her from moving. You should retain an attorney to assist you in preparing and filing the motion. You may need to request temporary restraining order.
