Legal Question in Family Law in California

Gambling debts

I live in a community property state. I just found out my husband has been gambling on the internet and has incurred close to 100,000 in gambling debt. Am I liable for half if I didn't know about it or benefit from it?

Reply: Gambling debts

In a general sense you are both responsible for the debts incurred by either of you during the marital period. In a general sense, the Court might view his conduct as a breach of his fiduciary duty and make appropriate orders based thereon.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
