Legal Question in Family Law in California

garnishment

If I placed a garnishment on my ex for changing the alimony payment schedule and now under our agreement it is to be modified according to that agreement-he said he would contact a lawyer and hasn't. I am still receiving the payment, unmodified, what are my rights? Will I have to pay this money back or since he is doing nothing, do I legally have a right to it? I have done my part according to the agreement by telling him what I make, etc. Divorce Agreement was in Alameda County in California

Re: garnishment

the court order controls. if you need a new one, then create a stipulation. it must be signed by both of you and submitted to the court for the judge's signature. if you don't know how to do that, consider hiring an attorney.
