Gifted and Talented Children and Custody
I'm in the process of divorce and we have an open custody case. My husband has temporary primary custody of our two younger children, based on their staying in the school they have been in most of their lives. He obtained this custody because I wanted to move the children to a school district (only 8 miles away) where their Gifted-ness would be addressed. The schools they attend, now, offer little to nothing and our oldest is failing due to his frustration with the school system. He also wants to ''test out'' of school and attend the local college. My husband has gotten a court order to keep our children in the inadequate school system. Is there any way of fighting this legally? All three children now want to live with me and attend the better schools. I am educated and informed as to their educational and emotional needs. Their dad is not----hasn't even read an article on giftedness.

I would have to take a look at the existing orders, pleadings, etc. If there is a change in circumstances you can always petition to the Court for a change in the custody orders.
