Legal Question in Family Law in California
Is girlfreinds income relevent?
Hi-A freind of mine lives with her boyfreind (in orange County, CA )He has two kids that he pays child support on...the two kids live with their mother in Nevada....He pays $710.00 a month to his exwife plus $400.00 a month to cover health insurance for he and the two kids. ..The exwife lost her job and filed for more support money..(The exwife is remarried, lives with new hubbys, his 5 kids, her 2 kids) The calif courts have ordered that for the next 3 montrhs my freind (Joe) pay an additional $300.00 to the exwife, and that the exwife show the courts due diligence in finding a job. The courts told Joe that not only is HIS income relevent to calculate the amount of support deemed acceptable to pay the exwife, but also his girlfreind's (Chloe) income is necessary as well (They are'nt married, she works and goes to college, he works two jobs) .
How or why is Chloe's income related to Joe's child support issue? does she have to give them that info? its not her kids. what if they ''pretended'' to break up? . The Courts claim that money made by the girlfrend IS relevent to the support issue., However the courts also claim that the amount of monthly rent that Joe & Chloe pay pis NOT revelent to the support issue. Any ideas?

Doesn't make sense that the court is stating that the girlfriend's income is relevant. It isn't relevant except in some certain instances, and this situation doesn't sound like one of those instances.

sounds like somebody misunderstood the judge. get a copy of the court transcript and take it to an attorney.
