If my girlfriend doesn't have papers to be in the united states can she keep my daughter? Even when she claims I'm cheating?

Having papers does not prevent a parent from having custody of their child in the United States. In California each parent has an equal right to custody of the child. It does not matter if one parent is cheating on the other. The courts generally prefer that each parent have frequent and continuing contact with the child.
