Legal Question in Family Law in California

My girlfriend is currently going through a prolonged divorce. Her and her soon-to-be ex have been separated for over a year and live in separate residences. Would there be any kind of legal issues if I were to get her pregnant before the divorce is finalized?

The soon to be ex would be the baby's presumptive father if the couple was cohabiting and the husband was not sterile.
