Legal Question in Family Law in California
my girlfriends exhusband of 8 years is taking my girl to court to try and get full custody of there kids because she fell in love with me. im an exfelon with 2 years clean and sober. not on probation or parole. no violence or wierd sex stuff, just petty thefts. can he get full custody of them, she already has 60% custody. we think he is jelous. hes saying his concern is that im bringing drugs into the house with the kids, but im clean and sober. does he have a case?

I think that he has reason to have some concern. If you are clean and sober and there are no concerns outright then, most likely the custody order will not be disturbed by this. But the fact that an ex convict is sharing a house with minor children, does give him legitimate reason to file a motion in court to have this issue examined. I wouldn't worry too much if you are on the straight and narrow. You should consult a local attorney in your area to help you with your case if you have further questions.
For self represented individuals you can consult with the family law facilitator self help center at your local court house.
As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
