Legal Question in Family Law in California
Giving up custody
I would like to join the Marines but I am not married and have a 4 year old daughter. In order for me to go into the service I need to give up physical custody of my daughter. However, her father is in prison for the next year. What I would like to do is give him full physical custody of her now, but leave my daughter with her grandfather until her dad gets out of prison. Do I need him to go to court with me to give up my custody? Also, if I gave custody to someone besides her father is there anyway it could be backdated to a year ago?

Re: Giving up custody
You can file a stipulation with the court so that no physical appearance is necessary.
