Legal Question in Family Law in California

Granddaughter's Custody

My grandaughter has lived with me for 16 months. Mother is in North Carolina and father is in route to Ohio with his and granddaughters things. He wants me to send her by plane when school gets out. He has physical custody and joint legal custody with mother. Mother moved to NC 2 years ago. She nor I want granddaughter to go to Ohio. If we fight and lose, he will make sure we don't see granddaughter again. He has made veiled threats. Mother & I would both love to have custody and it is important that father lose. What can we do?

You have two choices

You have two choices. You can either file a petition with the court that has jurisdiction over the case asking the court to change the custody or you can return the child to the father.
