Legal Question in Family Law in California

My granddaughters mother beat her with a broom, left many bruises. After filing a police report of abuse, DCFS removed 3 children from mom's home and put them with family. DCFS is giving her the kids back on Tuesday. She will have to do a few things first (I'm guessing that she must get them beds to sleep in). But they will go home to their abusive mother and will be monitored by DCFS. Can I petition for guardianship of my granddaughter on Tuesday morning when she returns home to her mom? There is still a police investigation to be done. Or do I have to wait to see what else to see what else DCFS is going to do about it... Many thanks!

You may still file a Petition for Guardianship with the probate courts prior to the time that she is returned to her mother's home. You will likely want to retain an attorney in that county to assist you in the matter.
