Grandparent rights

I live in Yuma, AZ, my grandson lives in Indio, CA. I have never been allowed to see him. Can I file for grandparents visitation? There is a case pending in Riverside County courts for father's visitation.

The baby's parents have never been married.

You can file, but most likely it won't be granted. The courts figure that the parents have a say in who can be in their child's life. If your son was deceased, then you would stand a chance of getting visitation. Your son has a right to visitation, as long as there are no substance abuse issues or abuse issues, and through your son, you will be able to get visitation, unless your son says you're not entitled to have visits. But as long as you and your son get along okay, and as long as there are no other problems, help your son to get visitation so that he can let you see your grandchild.
