Legal Question in Family Law in California
Grandparent needs urgent assistance w/custody of 9 year old grandson...
My 9-yr.old g'son was born when my daughter was 14 & his dad was 19. Dad made it clear he wanted no part of this child. Subsequently, I was given the 4-month old baby, & raised him & supported him (solely) from that point. 4 years later, dad meets child, I file guardianship thru probate which supports family reunification.I was ordered to cooperate & allow mother & father ample & frequent visitation. G'son remained in my care & custody until just last year. G'son now lives with dad, who now has legal & physical custody (obtained unethically). My daughter passed away 6/14/03. My g'son has only known me as ''mom''. Dad is very angry, abusive & insecure & I have long suspected dad belittles & bullies his son, is emotionally & verbally abusive - proof of which has now finally come to light. In addition, my g'son is exposed to drugs & other inappropriate behavior. I need help insofaras TRO & changing current custody. This child now has severe stomach pains on a daily basis, is not sleeping properly, is having problems at school & is scared to death. Should I revisit the guardianship? File a new case in family court? Please reply, if possible, as soon as possible. Thank you.

It is unclear why the guardianship was terminated and the father obtained custody. However, if you now have information that the child is not properly being cared for, or is in danger, you should act immediately. Depending on the circumstances, it is possible that a new guardianship will need to be established. The court will act in the best interest of the minor child. You should contact an attorney to discuss this matter further.
