If the parents have been accused of improper parenting, the court may look to the grandparents for care, but it is an unusual circumstance. Barring unusual circumstances, grandparents have no right ti custody or visitation.

Another exception to the rule would be if the grandparents have a significant history caring for the child(ren). In that instance, the California court may allow the children to reside with the extended family that provided that day to day care. The court pleading would be a guardianship.
