Legal Question in Family Law in California

Grandparents rights

Iam legal guardian of my 2 grandchildren and the maternal grandma who is mentally ill has filed for visitation. Problem she is an unhealthy influence on the children ages 12/13yrs. the mother is deceased and father is disabled. parents of the children were never married. What grounds does she have for visitation? I have had custody since 1991. This grandma discusses and incurrages immoral issues with the children & calls them obsene names when she is upset with them. since the parents were never married does she have grandparent rights?

Re: Grandparents rights

She has the right to SEEK visitation. That does not mean she will get visitation. See Family Code sections 3102, 3103 and 3104. This grandma should, under law, be denied.
