Legal Question in Family Law in California

Grandparents visitation, son passed away.

My son passed away approximately 4 months ago. Since that time my grandchildrens mother (she and my son were never married), refuses to let us see our 4 grandchildred. The kids have always spent Holidays, Birthdays, BBQ's etc with our family. We would like to continue to have a relationship with our grandchildren, do we have any rights to visitation? If so will it be necessary for us to retain an attorney or can we simply file for visitation with on our own?

Thank you in advance for you assitance.

Re: Grandparents visitation, son passed away.

You should discuss your case with an attorney. Grandparents may have visitation rights, but to get an order for visitation it is necessary to show that visitation is in the best interest of the child. Therefore you should take immediate action. The longer you delay the more difficult it is to show contact is in the child's best interests.
