It is unlikely that he will be able to get a court order that you return the children to California. Assuming that the children are doing well in there present home, there would be no reason for the court to order the children returned to California.

The court cannot order you to return to the state. The court can order the children to return to the state, however, that would be unlikely. I would suggest that you go over your case with a family law attorney in the county in which the case is currently filed who can give you more complete advice a probably give you more comfort with the answer.

Good Luck, Pat McCrary
