Grounds for missing a hearing
I missed a hearing in family Court. I submitted a declaration requesting a Continuance based on emotional distress. My son had recently been raped while under the care of the Plaintiff and was now visiting with me. I provided evidence in my declaration to the Court of the rape (a copy of the district attorney's document charging the older children who raped my son) and I was ignored. At a later hearing the same judge claimed surprise at the news of the rape indicating that he did not even read my declaration at the previous hearing. Can I vacate the judgments of that hearing claiming the Court should have provided me the continuance I sought?
