Guardianship in California
My brother is married he lives in Louisiana and his wife lives in California. They have a 4 year old child. A third party non relative is seeking guardianship from the mother. My brother is filing to oppose this guardianship. Is there any reason he would be denied? Can he just travel to California and arrange to pick his daugther up from the 3rd party? Shouldnt this automatically be thrown out once he appears? They are still married.

Nothing is automatic in court. And courts take issues concerning children very seriously. Walking into court unprepared thinking you're going to walk out with what you want doesn't happen very often. Better get a lawyer and get ready.
