Legal Question in Family Law in California
Guardianship of a child
Divorced in 02
Tried to initiate the agreed upon visitation with no assistance from ex wife. Mediation agreement stated that visitation was to be ''agreed upon'' ex wife was unwilling to work with me.
Sent mail the daughter in 2003 that was returned as ex had moved with daughter I have had no knowledge of where they were until I saw them around town recently.
The grandparents now have our daughter because of the actions of my ex wife and her boyfriend. Because of everything our daughter has been through and because it's been so long since I have seen her I believe that her grandparents probably should have guardianship. I do however want to be able to visit with her. How can I consent to guardianship but also ask for visitation?

Re: Guardianship of a child
You will be notified of the guardianship hearing. You can ask for visitation at the hearing. However, it would be a good idea to file and serve a declaration with the court ahead of time informing the parties and court you will be seeking visitation rights.

You may wish to retain an attorney. Please understand that you will be required to pay child support for this child. Good Luck, Pat McCrary
