Guardianship

I have filed for guardianship of my niece who has been in my custody since 1997. Both Mother and Father abandon her and now the father is trying to take her from me so that he will not hav to pay childsupport. Can this happen? Child is 12yrs old

It is possible. The fact that he has not had significant contact with her for 12 years you should have a good chance of winning. However your case will have to be properly presented. There is a family code section around 4020 as I recall that provides that proving that you acted as a parent on a day to day basis can satisfy the requirement for detriment.
