Guardianship
I have legal guardianship of my grgrandchild.Her mom is in jail for drugs & forgery,will get out in June.Will be on probation for 2-3yrs.They tell me I have to go to Probate Court to have anything done.CPS won't do anything since they are not the ones that started this.I don't want the mom to be able to take this child whenever she wants to when she gets out.I don't mind visition rights with someone watching her.I don't want that child to be put in a position with her mom that might get her into trouble.I would like to know how to go about doing this & what I need as far as paper work.Is it going to cost me any money, I'm on disability & a fixed income.We have gotten into 2 fights before she went to jail over her trying to take the child.I don't want to go through that again. Any help someone could give me would be very much appreciated.

Unless there is a court order giving you custody of your grandchild mom will be able to come and get the child when she gets out of jail. You should file a petition to be name guardian of your grandchild. Retain an attorney to represent you, and assist in preparing the petition. If you cannot afford an attorney inquire about a law clinic or community legal aid.
