Legal Question in Family Law in California
Guardianship of my son-born while I was incarcerated
I had a son who was born while I was incarcerated(drug). The mother was 19 and chose to give guardianship of the child to a mutual friend. I was released 6 months ago and have been doing everything to get my life back on track. I am working and saving for my own home while living with family. I expect to move into my own house in the next couple of months. I was allowed visitiation with my son who is now 3 on wends. and fridays for overnite. For a few months. When the guardian learned that I wanted custody of my son. She ceased visitation and refuses my phone calls. She is now traveling in and out of the State. The court papers I have say I have Full Visitation. How do I go about enforcing the visitiation since the court papers only say full visitation and not specific hours and What will the judge be looking at in order for me to get custody of my son. Any help or information would be greatly appreciated since all my funds are going into trying to get into a home for me and my son.

Under the set of unfortunate circumstances, your best option here would be to schedule an OSC hearing (order to show cause), in order to present your factual circumstances and hopefully get a modification order promptly.
