Legal Question in Family Law in California
Guardianship
We have a 16 year old from our church living with us for over 6 months. We are considering guardianship so that he can be added to health insurance and car insurance. His mother lives in the area but cannot care for him plus other troubled children. How do we pursue guardianship? Who to contact? Fees involved? What is his mother's involvement with us getting guardianship?

Re: Guardianship
You've got to get the Mother's approval and then you can file Petition for Guardianship. Even without the Mother's approval you can probably convince the court but really try to get that approval. It will cut the costs in half at least.
Re: Guardianship
A petition for guardinaship would be filed with the probate department of the superior court in the county in which your reside. Call the court clerk and ask for the amount of the filing fee. If mother supports the guardianship, it will be fairly simple to obtain the guardianship. However, if she opposes the application you will be faced with a fairly lengthy trial with significantly higher attorney fees.
Re: Guardianship
If the mother agrees to the guardianship then that is one issue successfully handled. Next, you need to know who the father is. He needs to be noticed of the petition. If either or both parents object to the guardianship that does not, in and of itself, mean that you won't be successful. It does mean however, that you should have some attorney in your corner.
