My Son in Law is incarcerated in the staate of texas

his Wife and Kids live here. what rights if any does he have regarding his children and could he transfer those Rights to me?til such time that he is released.The childrens Mother lives with a boyfriend who is mentally abusive to the Kids and my son in law would like for me to have the kids.

Also how old does a child have to be bevore he or she can choose who they want to live with

The father's rights cannot be transferred. After age 13, a judge must listen to a child, but certainly does not have to go along with what a child wants.
