Legal Question in Family Law in California

Half Child Care Costs

I have a 3 year old son in CA and I live in TX. I currently make 13.50 an hour and pay $426 a month for child support. I have another one year old son with my wife that lives with me and I have never asked for a reduction b/c I was trying to be as fair as possible even though now I have another child to support. It is very hard trying to make ends meet while paying that much in child support. The mother constantly rubs things she buys in my face like $300 worth of energy pills and she makes more money than me. Now she is taking me to court in CA to ask for 1/2 child care. I have responded to her summons and had her served. I also have financial hardships because of medical bills because my son that lives with me has special needs because of his premature birth. I am planning on calling into the hearing to dispute this. What are my chances of having to pay 1/2 child care? I included all the medical bills from my son (over $5,000) in the response. Is there any advice you can give me as to what to say to the judge to convince him that I cannot afford to pay this woman any more money? Please help!!!

Re: Half Child Care Costs

Reimbursements are covered under Family Code Section 4063. With rare exception the judges order

the payment of uninsured medical and dental expense split evenly between the parties. Yours might be an exception, but you would be better off retaining an attorney. If your order

doesn't contain that provision it would probably be added. Good Luck, Pat McCrary
