Legal Question in Family Law in California

How can this Happen?

My son'e wife took my grandaughter away 12-03 out of state to Georgia without his consent, they are still there. He went through the legal way to get her back, it's not happening. How can this happen?

She seems to have ALL the rights, he just got hit up for child support... she signed up for welfare in Georgia.

She is calling all the shots and getting away with it all. I miss my grandaughter, I want to be able to see her! She just turned two in December. I feel if I went to Georgia I STILL wouldn't get to be with her.

He filed for divorce and that hasn't happened either. I just don't get it. I thought you had to have written permission to take a child and move when you feel like it.

Your son needs to take his paperwork to an attorney and discuss the facts and options. You need to understand the system to know how to use it to your advantage. A parent does not need permission to take a child out of the state, unless there is a statutory or court imposed prohibition.
