Legal Question in Family Law in California

Am I harassing the mother?

Hi, I'm a stepmother of a 7 year old child whom I've raised since age 2. My husband has physical custody and the mother has visitations. She lieves in another state and both her and my husband are active duty in the military. The child is with me most times because my husband is gone a lot due to work, and he has never lived with the mother, only visits everyother holiday. The problem is that the mother does not let me talk to the child during visitations. The child asks me to call him because she does not let him call me when he asks her, and when I call she does not answer. I have sent her many text messages begging her to let me talk to the child and I have told her that what she is doing is wrong, but she says that I am harassing her, and warms me to stop. Am I really harassing her? Don't I have the right to talk to the child when he's with her?

Re: Am I harassing the mother?

You are not harassing the mother. Your husband should bring a motion to modify the child sharing order that would allow you contact with the child during mother's visitation. That would be in the child's best interest. Good Luck, Pat McCrary
