Legal Question in Family Law in California
Harassment through use of Child Protective Services
I was in a domestic violence shelter approximately two years ago. The father of my children still has visitation. I carry the responsibility of raising the children. These children are under the care of psychiatrists and psychologists. Several times this man has either contacted CPS or the doctors office to claim I use drugs. I have submitted to a hair follicle test. I have been randomly tested. It is his way of harassing me or causing me grief with the neighbors and my school. I have proven time and time again that these are false accusations. Is there anything I can do to make this stop?

You should file a OSC requesting an order restraining him from making further reports about. The court may be reluctant to do make such an order. But making the motion will bring his bad conduct to the attention of the court.
Usually CPS picks up on attempts to use child abuse reports to harrass the parent and takes no action such reports.
